These Terms of Service ("Terms") govern your use of the FITAVID mobile app and related services provided by ShopperTrendz LLC, doing business as FITAVID. By creating an account or using FITAVID, you agree to these Terms.
1. FITAVID is a fitness and wellness tool
FITAVID helps users organize fitness and wellness goals through Circles, check-ins, streaks, progress tracking, and community accountability. FITAVID does not provide medical diagnosis, treatment, or individualized medical advice.
Consult an appropriate healthcare professional before beginning or changing an exercise, nutrition, or wellness program if you have questions about what is suitable for you.
2. Accounts
You are responsible for providing accurate account information, maintaining access to your authentication method, and safeguarding your account. You may not impersonate another person, misuse another person's account, or attempt to bypass security controls.
3. Circles and community conduct
FITAVID may allow you to create or join private or public Circles and interact with other members. You agree not to use FITAVID to harass others, post unlawful or abusive content, interfere with the service, distribute malware, scrape data without authorization, or use the service for fraudulent or deceptive purposes.
Circle owners and members are responsible for the invitations and content they choose to share. We may remove content, restrict access, or suspend accounts when reasonably necessary to protect users or the service.
4. Health and activity integrations
If you connect Apple Health, Health Connect, or another supported service, you authorize FITAVID to access only the categories you approve. Device and third-party measurements may be delayed, incomplete, or inaccurate, and should not be relied upon for emergency or medical purposes.
5. Availability and changes
We may add, change, suspend, or discontinue features as FITAVID evolves. We work to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation.
6. Intellectual property
FITAVID, its branding, software, interface, content, and related materials are owned by ShopperTrendz LLC or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer ownership rights to you.
7. Your content
You retain ownership of content you submit. You grant us the limited rights necessary to host, process, display, and transmit that content for the purpose of operating and improving FITAVID and providing features you request.
8. Account termination
You may stop using FITAVID at any time and may request deletion of your account. We may suspend or terminate access when these Terms are materially violated, where required by law, or where necessary to protect the service or other users.
9. Disclaimers and limitation of liability
To the extent permitted by law, FITAVID is provided on an "as is" and "as available" basis without warranties of uninterrupted availability, fitness results, or accuracy of third-party health data. To the extent permitted by applicable law, ShopperTrendz LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service.
10. Changes to these Terms
We may update these Terms from time to time. The current version will be posted at this URL with its latest revision date. Continued use after an effective update constitutes acceptance where permitted by law.
